The Problem With Pro Se or “Do It Yourself” Divorces And Forms:

 

Frequently our attorneys at Martin, Dugan and Martin deal with issues arising from a divorce, child custody, or guardianship proceeding in which the parties did not hire or consult attorneys. Failing to hire or consult an attorney can and will cost you greatly. For instance, failing to hire an attorney results in you not having an advocate on your side or anyone looking out for or protecting your rights. You may end up signing forms and agreeing to a settlement in which you give up the right to property you could have had, or in which you give up access to your child that you might otherwise have been entitled to if only you had retained a lawyer to explain and advocate your rights. Once you agree to a settlement or a custody arrangement, it can be difficult or impossible to change if it later turns out you regret what you agreed to, or if you later find out that you should have gotten more under the law. A court is not likely to inquire as to your rights in the first instance, and is even less likely to let you out of your agreement. Asking the Court to set aside a signed agreement and fix your errors often costs more time and money than it would have to hire a lawyer initially. Hiring a lawyer to inform you of your rights and advocate your interest is less expensive than you may realize, and makes sense if you want your rights protected.
